Terms of Use
These Terms of Use (TOU) define the conditions for access to and use of the Racine platform, available via the website, mobile applications, and related services. Access to the platform implies unconditional acceptance of these TOU by any user.
1. Purpose
Racine provides a digital intermediation service between producers, buyers (individuals or professionals), and public authorities. Racine acts solely as a technical intermediary and is not a party to commercial transactions between users.
2. Definitions
"User": any natural or legal person using the platform. "Producer": a user offering goods or services through Racine. "Buyer": a user making a purchase or reservation through the platform. "Public authority": a public or semi-public body using Racine to support and reference producers. "Services": all features offered by Racine (discovery, matchmaking, ordering, sales, tracking, API, dashboards, etc.).
3. Access conditions
Access to the Services requires creating a user account. Users undertake to provide accurate information and keep it up to date. Racine cannot be held liable for incorrect data provided by users. Racine reserves the right to suspend, restrict, or delete access for any user in case of TOU breach, fraudulent activity, or non-compliance with the law.
4. Intermediation and liability
Racine provides a technical platform facilitating connections between producers and buyers. Racine is not a party to commercial transactions and is therefore not responsible for the quality or compliance of products/services offered by producers, for delivery or payment between users, or for commercial disputes, delays, or defects identified during transactions. Racine's liability is limited to direct damages caused by a proven breach of its contractual obligations, up to the amount paid by the user for the relevant subscription or service.
5. User obligations
Users undertake to comply with applicable laws and regulations, especially regarding food safety, hygiene, and commercialization; provide accurate and complete information when registering and publishing products/services; not publish unlawful, fraudulent, offensive, or misleading content; not disrupt the platform (intrusion, hacking, spam, data manipulation); and ensure confidentiality of their credentials while reporting any unauthorized use.
6. Public authorities and specific professional users
Public authorities use Racine through specific contracts granting access to extended services (API, dashboards, producer management). They remain responsible for use made by their agents and for content published through their account. Any breach of contractual obligations or these TOU may result in suspension or termination of access.
7. Intellectual property
All components of the platform (logos, source code, databases, texts, images, design) are the exclusive property of Racine or its partners. Any unauthorized reproduction, distribution, or use is strictly prohibited. Users grant Racine a non-exclusive right to use content published on the platform for the purpose of providing the services.
8. Personal data
Racine collects and processes personal data in accordance with the GDPR and the Privacy Policy. Users have rights of access, rectification, erasure, restriction, portability, and objection. Data may be shared with technical providers or other users when necessary for service execution (e.g., delivery contact details).
9. Security
Racine implements technical and organizational measures to protect data and the platform (encryption, backups, restricted access). Absolute security cannot, however, be guaranteed. Users remain responsible for the security of their account and credentials.
10. Suspension and termination
Racine may suspend or terminate access in case of TOU breach, fraud, or legal request. Users may delete their account at any time. Suspension or termination does not affect existing financial or contractual obligations.
11. Changes to the TOU
Racine may amend the TOU at any time. Users will be informed of major changes. Continued use of the platform after notice constitutes acceptance of the updated TOU.
12. Limitation of liability
Racine is not liable for indirect losses (loss of revenue, profit, business interruption, data loss, reputational damage). Racine does not guarantee absolute availability, accuracy, or security of the Services.
13. Governing law and jurisdiction
These TOU are governed by French law. Any dispute relating to the use of Racine shall be submitted to the competent courts within the jurisdiction of Racine's registered office, unless mandatory legal provisions provide otherwise. Executed in Clermont-Ferrand, France.
